- According to Articles 124 and 217 of the Constitution of India, a judge of the Supreme Court or High Court can be removed by the President on the grounds of ‘proved misbehaviour’ or ‘incapacity’. The removal process requires a motion to be passed in both Houses of Parliament:
- By a majority of the total membership of the House, and
- By a two-thirds majority of the members present and voting in the same session (Special Majority).
- The Constitution does not define the terms ‘proved misbehaviour’ or ‘incapacity.’ However, the Supreme Court has clarified in its rulings that actions such as deliberate misconduct, corruption, lack of integrity, or crimes involving moral turpitude are considered misbehaviour.
- Incapacity is defined as a medical condition, encompassing physical or mental limitations, that prevents a judge from effectively performing their duties.
